last night. she had been shot several times and is undergoing surgery this morning. so far, they have not released any information about a suspect or motive. but will continue to follow the story and bring you new information as soon as it comes in. union workers could bring an official end to their labor dispute with b.a.r.t. today when they vote on the contract deal. amy holyfield is live at the b.a.r.t. base with a preview. amy. >> yeah, eric. you may have saw it. we heard the end of this b.a.r.t. strike. one more big step has to happen and that's today. the two unions will be taking the proposals to their members. if approved, the union workers will be getting a 15.4% raise over two years and they will start contributing to their pensions. but will this be the last b.a.r.t. strike that we will ever see inch there is a movement to ban transit worker strikes and that is also in the

news today. the city council member steve glazer wants to make it a law that transit workers can't strike. and he says he has gathered 20,000 signature owes a petition calling for a ban. and today, he and his supporters will march from the pleasant hill b.a.r.t. station to the office of the senate transportation committee chairperson to deliver those signatures. so still a lot to watch in this story. reporting live, amy holyfield, abc 7 news. a new twist involving the sheriff's deputy who shot and killed a teenager carrying a realistic looking rifle. a man came forward saying the same county deputy recently pulled a gun on him two months ago. jeff westbrook claims he was pulled over for a traffic stop when the deputy twice pulled out his gun in an encounter. his attorney says a veteran with lots of experience would only pull his gun if there was a need and that the shooting of

13-year-old andy lopez last week was the first time gaylehouse had actually fired r fired his gun in the line of duty. the south bay father whose two children spent more than 17 hours inside a suv is due in court today. a neighbor found the 10-year-old girl and 8-year-old boy cold, tired and hungry and called police. we have the story. >> police say 29-year-old julio reyes drove his two kids two to north hill view drive and left them in his suv seen in this photo. it was 10:00 tuesday night and reyes was off to visit a friend in the area. police got a called from a concerned neighbor who noticed the kids at 12:42 the next afternoon. >> the officers show up and find a 10-year-old female and an 8-year-old male all by themselves in the car and they're tired and they're cold and they're hungry. >> the kids were taken into protective custody. the officers bought them food while the department tried to track down reyes. >> we called local hospitals.

we called both alameda county and santa claire county to see if he was in county with no luck. >> finally, wednesday night, more than 24 hours after police say he left his kids, reyes called them to report his vehicle and children missing. the neighbor who called police didn't want to be on camera, but told me she heard honking from the suv and saw little feet pressed up against the horn. she figured it was a neighbor's car, but a nagging feeling that something just wasn't right made her call 911. >> i work for the school district, so it's just hard to -- it's difficult to hear that a parent would actually do that to their own kids. >> the children's mother was contacted and met with police, but the boy and girl remain in the care of the department of family and children services while police investigate. abc 7 news. two boys are in serious condition this morning after a

car hit them in the sonoma county community of cloverdale. a car struck the boys in a crosswalk at hillsburg avenue around 7:00 last night. one boy is 12. the other is 13 years old. paramedics air lifted one boip boy to children's hospital oakland and the other was taken to a nearby hospital with head and shoulder injuries. the 75-year-old driver is cooperating with investigators. a teenager is in the hospital after suffering a serious injuries in a high school football game lai last night. it habit at liberty high in brentwood against heritage high last night. the school's principal tells abc 7 news the student's injuries were serious enough that he was air lifted to a hospital, but he declined to give any details. new details this morning about the united airlines flight forced to make an emergency landing shortly after takeoff from san francisco. the floois flight was diverted to phoenix yesterday after crew

reported the threat. abc news reports someone found the word bomb on the rest room on the plane. passengers were evacuated. the bomb squad searched the plane and found nothing. 42 passengers were rescreened, rebooked and just landed at their destination. well, your pg&e bill won't go up as much as fist thought. to pay for an overhaul of the pipeline system. the san jose news reports the amount passed on to rate payers will be lower because pg&e now expects to replace 145 miles of pipeline rather than the 185 miles originally projected. customers will now pay $900 million of the $1.5 billion project. the window opens today for the legendary match rick surf conseft off half moon bay. they're hoping for the waves. these are shots of waves

eating all that candy last night, halloween night. a woman is suing mcdonald's after suing for burns from hot coffee that spilled on her lap while going through the drive through. we all remember the incident, a jury awarded stella nearly $3 million for her burns 20 years ago. now, back then, mcdonald's kept coffee between 180 1k3 190 degrees. franchises now keep their coffee at 10 degrees cooler, but it's still as much as 30 degrees higher than the coffee you brew at home. so, 74-year-old joel afino wants that to change. >> i went in to get coffee and, you know, it's their fault. it was too hot. the lids weren't on right. >> her attorney admits she didn't suffer millions of dollars of injuries, but they're still suing for millions, anyway, claiming mcdonald's is still putting profit over people's safety. mcdonald's has not commented on the lieutenant.

california high speed rail authority has come full circle when it comes to routing its bullet trains. they're now suggesting a route east of hansford to bakersfield. they had recommended a similar plan before, saying it was easier on the environment. but then, back in april, planners changed the route to the west, calling it more efficient. but farmers in the area complaincomplai complained about possible damage to their property, so the plan has been changed back to the east. >> much of the country is waking up to the aftermath of frightful halloween storms. the system left behind a large, constructive trail producing a tornado that suchd down in texas. >> mother nature delivered a trick, frightening weather to put halloween on hold across the nation's mid section. thunderstorms, towards central texas, several areas were flooded. cars were no match for the rising water. helicopters rescued hundreds south of austin. emergency crewes and boats went
